Notable Outcomes:

June 2026:Successful Defence of Emergency Trust Application

Represented the Respondents in an urgent application seeking an order to hold the proceeds of the sale of their property in trust pending the determination of an unjust enrichment claim. The Respondents, as the registered legal owners, required the sale proceeds to complete the purchase of a new home. Successfully opposed the application, with the Court finding that the legal test for preserving the funds in trust had not been met. The application was dismissed, allowing the Respondents to access the sale proceeds, and the Court awarded substantial costs in their favour.

May 2026: Successful Interim Parenting Time Application

Represented the father in an interim application before an arbitrator seeking summer parenting time with his children. Successfully obtained an order granting the application, with the arbitrator awarding the father the parenting time sought in the interim application.

January 2026: Successful Resolution at Judicial Dispute Resolution:

Represented the father at a Judicial Dispute Resolution (JDR), successfully negotiating a consent parenting order that awarded him primary care of the children. The matter involved complex parenting issues following the father’s relocation with the children from their habitual place of residence to another city. The negotiated resolution avoided the need for further contested litigation while providing a stable parenting arrangement in the children’s best interests.

January 2026: Successful Application for Interim and Retroactive Child Support

Represented the mother in an application for interim and retroactive child support. Successfully obtained an order for ongoing Section 3 child support and Section 7 special or extraordinary expenses, together with retroactive Section 3 child support and Section 7 expenses dating back to the child’s birth in 2019 enforceable through the Maintenance Enforcement Program (MEP). The Court imputed income to the father for the purposes of calculating his child support obligations. The Court also awarded enhanced costs to the mother.
